These Terms of Service (“Terms”) apply to the quotes, services and website provided by Rivera’s Landscape NTX LLC, operating as Rivera’s Landscape (“Rivera’s Landscape,” “we,” “us”). By requesting a quote, scheduling service or paying an invoice, you agree to these Terms. If a written quote or invoice we give you says something different from these Terms, the quote or invoice controls for that job.
Quotes and estimates
Quotes are free. A quote is based on what we see at the property and what you tell us, and it describes the work and the price. If the job turns out to be different from what was quoted (for example, hidden rock, roots or drainage problems, or you ask for extra work), we’ll explain the change and agree on it with you before doing the additional work.
All prices are in US dollars.
Scheduling and weather
We schedule work on the dates we agree with you, but outdoor work depends on the weather. Rain, freezing temperatures, extreme heat or wet ground can move a visit. When that happens we’ll move it to the next available day. We aren’t responsible for delays caused by weather or other conditions outside our control.
Recurring service and cancellation
Recurring service, such as weekly or every-other-week mowing, continues until you or we end it. You can cancel recurring service at any time by letting us know by phone, text or email before your next scheduled visit. You only pay for visits already completed. We may also end recurring service by giving you notice.
For one-time projects, please tell us as early as possible if you need to cancel or reschedule. If materials have already been bought for your project, we’ll talk through those costs with you.
Payment
Online payments are processed securely by Stripe. Invoices are due on receipt unless your quote says otherwise. Larger projects may require a deposit before work begins; if so, the amount will be stated in your quote. If an invoice goes unpaid, we may pause service until the account is current.
Satisfaction, re-service and refunds
If you’re not happy with a service, contact us as soon as you can and tell us what’s wrong, and we’ll work it out with you. Any refund we agree to goes back to the original payment method.
Plants, sod and trees are living things. Unless your quote says otherwise, we can’t guarantee that they’ll survive, because their health depends on watering, weather and care after we leave.
Property access, pets and utilities
- Please make sure we can get to the work area on the scheduled day: gates unlocked, gate codes shared and vehicles moved where needed.
- Please keep pets indoors or secured while we’re working, and pick up pet waste from areas we’ll be mowing.
- Tell us about anything hidden in the work area, such as sprinkler heads, invisible pet fences, landscape lighting wires, septic systems or private utility lines.
- Texas 811, the “call before you dig” service, marks public underground utilities but not private lines such as sprinkler pipes, landscape lighting, pet fences or lines running to outbuildings. We aren’t responsible for damage to private lines that weren’t marked or pointed out to us.
- You’re responsible for any HOA approvals or permits your project needs unless your quote says we’ll handle them.
Damage
We work carefully, but if you believe we damaged something, please tell us as soon as you can, with photos if possible, and we’ll look at it with you.
Photos of our work
We may photograph completed work and share those photos on our website or social media. We won’t publish your name or street address with them. If you’d rather we didn’t share photos of your property, just tell us.
Limitation of liability
To the fullest extent allowed by Texas law, our total liability for any claim related to a service is limited to the amount you paid for that service, and we aren’t liable for indirect, incidental or consequential damages. Nothing in these Terms limits liability that can’t be limited under Texas law.
Our website
The information on this website is general and may change. It isn’t an offer or a quote. A price or scope is only confirmed in a quote or invoice from us.
Governing law and disputes
These Terms are governed by the laws of the State of Texas. If a problem comes up, please contact us first; most issues can be sorted out with a conversation. Any legal action related to these Terms or our services must be brought in the state or federal courts located in Collin County, Texas.
Changes to these Terms
We may update these Terms from time to time. The effective date at the top of this page shows when they last changed. Changes don’t affect services you’ve already paid for.
